Superior Court temporary restrains Del Mar Pot Collective due to city of Del Mar lawsuit

 

Due to pressure from city of Del Mar leaders, the 1105 Cooperative, the only medicinal marijuana storefront outlet between La Jolla and Carlsbad, Del Mar and Rancho Bernardo, shut its kind bud doors on Tuesday, July 12.

Del Mar leaders sued the medicinal marijuana store. A Superior Court judge ordered a temporary injunction based on city of Del Mar contentions the cooperative lacked city business permits.

Sleazy that the city of Del Mar with wall-to-wall millionaires collects more money in traffic fines -- more than $650,000 annually --  than all but SEVEN California cities, all much larger. Sleazy, that the city with bogus parking enforcement rips off people for operating expenses so millionaires can skate, then turn around and use some of that money to stop people dealing with suffering as is appropriate under California law.

Del Mar sued the 1105 Cooperative and its manager, Patrick Kennedy, after the dispensary opened March 31 while its business license application was on hold. At 5 p.m. that same day, a city staffer hand delivered Kennedy a letter denying his business license.  The 1105 Cooperative, across from City Hall at 1105 Camino del Mar, kept operating despite $16,000 in fines from the city.

Del Mar served Kennedy, the 1105 Cooperative and building owners Wayne and Junie Young with the lawsuit June 28. Superior Court Judge Judith F. Hayes granted Del Mar’s request for a temporary restraining order, forcing the 1105 Cooperative to close immediately. A hearing for a permanent injunction is set for Aug. 4.

On Tuesday, Kennedy said he would fight this unjust action although he was complying with the temporary injunction.
